Maintenance Program

In order to ensure your plan accomplishes all your goals and objectives, minimizes the
burden to your loved ones, keeps control with your family rather than the courts, and
minimizes the after-death costs to your family, you may opt for our Maintenance & Fee
Guarantee Program, which provides comprehensive counseling to create a plan specific
to your goals and objectives, review of your plan to ensure it stays current with changing
laws, changes in your family, changes in your finances, and changes in your health, and a
guaranteed fee to minimize the cost to your loved ones after your death.

  1. Reasonable phone calls by you, your representatives, or your professional advisors to
    anyone in our office at no charge;

  3. Free document changes at your request (at attorney’s discretion)
  4. An annual client update workshop aimed at keeping you current with the changing
    legal environment;
  5. An annual client appreciation event (November)

  8. Law firm initiated changes to your documents, if requested, to take advantage of

    for other changes, as set out in the Engagement Agreement;
  10. On-going guidance with funding of new assets acquired during the year or funding
    additional assets;
  11. One Annual trust review at your request;
  12. Regular client newsletters to keep you apprised of changes that may affect you;
  13. Meeting with your family or helpers upon your disability or death to explain the Plan
    you created and outline the assistance available in maintaining or settling your plan
    (any new services, if required, will be identified, and billed separately);
  14. 10% Discount on future service

As part of our maintenance services, we may from time to time recommend legal changes
in your documents to take advantage of “general” changes (changes that affect all clients
the same) in Trust, Medicaid, Asset Protection, or tax law, regulations, or judicial
decisions. Other changes may reflect ideas or new strategies we
learn from experience. Both of these general changes are made at no charge and are
initiated by us rather than you. Beginning in January of next year and each January
thereafter, you will automatically be billed the annual maintenance fee as part of the
regular billing cycle. So long as you retain us each year by paying the annual update fee,
we will provide you with the maintenance services described in this paragraph.
If you are not enrolled in our Maintenance & Fee Guarantee Program, you will be billed
at our hourly rate or flat fee rate for any further legal advice provided. Of course, if you
wish to undertake an entirely different type of estate planning than your current plan
(such as going from a base Will to a Trust, Medicaid Planning, Life Care Planning or
Probate), then those changes would be charged at our regular fee rates for such new
documents or planning.

You will be notified of any increases in the maintenance update fee, if applicable, at least
thirty (30) days prior to the payment date. You, or we, may terminate the update services
at any time by notifying the other in writing within 30 days of the end of your annual
maintenance period. Non-payment of the maintenance fee by January 31, 2026 will
terminate all services and obligations provided hereunder including the fee guarantee for
Post Death Administration set forth in the paragraph below. Since this service has many
benefits far in excess of its costs (for example, one hour of attorney time is $500), there
are no refunds for cancellations during the year.


We also agree that so long as you stay in the maintenance program continuously without
interruption, upon your death we will represent your estate in Post Death Trust
Administration for one point five percent (1.5%) of your gross estate, homestead property
is charged separately.


As part of your participation in the update program, you agree that we may assume
that no significant changes in your health, family, or finances have occurred unless
you notify us. If changes occur, please notify us immediately and we will be happy to
take the necessary steps to address your concerns.


ALSO, IF YOU CHOOSE NOT TO PARTICIPATE IN THE MAINTENANCE PROGRAM IN
ANY YEAR, WE WILL NOT CONTACT YOU IN FUTURE YEARS ABOUT REJOINING, AS
WE DO NOT WANT YOU TO FEEL THAT WE ARE MAKING UNSOLICITED
SOLICITATIONS. THUS, IF YOU OPT OUT OF THE PROGRAM, IT WILL BE YOUR
RESPONSIBILITY TO CONTACT US IF YOU WISH TO REJOIN THE PROGRAM IN FUTURE
YEARS, BUT YOU MUST DO SO AND PAY THE THEN-CURRENT MAINTENANCE FEE BY
JANUARY 31 OF THE YEAR IN WHICH YOU WISH TO REJOIN.
